On September 2nd, 2010 the Vermont State Police began an investigation into a report of a grave site located at the Maple Hill Cemetery in Washington having been desecrated and the human remains (ashes) unlawfully removed.
This information came after a family member of the deceased, Michael Clark, was contacted by an anonymous source. Exhumation of the grave was performed in the beginning of September and it was confirmed that the ashes of Tori Lynn Clark had been unlawfully removed.
On 4/20/2011 Gene Sargeant, age 30 of North Waterboro, ME and David Mares Jr., age 30 of Barre were charged with unauthorized removal of human remains, a violation of Title 13 V.S.A. 3761.
On 04/28/2011 Rosalee Maria Moodie, age 22, of North Wolcott and Melissa Sue Estivill, age 32, of Barre were charged as accesories to unauthorized removal of humans remains, a violation of Title 13 V.S.A. 3761. Moodie, Estivill, Sargeant and Mares were cited to appear in Orange County Superior Criminal Court to answer to the charges on June 1st, 2011.
Unauthorized removal of human remains in Vermont is a felony and carries a penalty of imprisonment of not more than 15 years or a fine of not more than $10,000 or both.
