Judge: State must weigh in on Berlin Pond dispute

MONTPELIER – The State of Vermont will be forced to wade into a simmering dispute over recreational use of Berlin Pond, a superior court judge ruled Thursday.

Although Judge Geoffrey Crawford quashed subpoenas that would have compelled two state employees to testify on behalf of a Barre Town couple caught kayaking on Montpelier's public drinking water supply last September, he concluded the case could not proceed without the state's active participation.

"I don't see how we can go forward without hearing from the state," Crawford said, capping a brief back-and-forth that touched on the central issue in a recently filed lawsuit.
